By making a booking with Sail Malta Charters (“we”, “us”, “our”), you (“the client”, “guests”) agree to the following Terms and Conditions.
A booking is confirmed once:
· Availability is agreed, and
· The required deposit or full payment (as agreed) is received.
Booking details include date, duration, number of guests, and agreed itinerary.
· A deposit may be required to secure the booking.
· The remaining balance, if any, must be paid before departure unless otherwise agreed.
· Payments are processed securely via approved payment methods.
1.3 Cancellations & Refunds
· Client cancellations made more than 7 days before the charter date may be eligible for a refund of the deposit (excluding any non-refundable fees).
· Cancellations made within 7 days of the charter date are non-refundable.
· No refunds are issued for late arrivals or early returns.
Charters are subject to weather and sea conditions.
· If conditions are deemed unsafe by the skipper, we reserve the right to:
o Reschedule the charter, or
o Offer an alternative route, or
o Provide a refund
The skipper’s decision regarding safety is final.
Sail Malta Charters reserves the right to substitute the booked vessel with another vessel of a comparable size, standard, passenger capacity and onboard amenities where this becomes necessary due to circumstances beyond our reasonable control. Such circumstances include, but are not limited to:
Where a substitute vessel is provided, Sail Malta Charters will use all reasonable endeavours to ensure that it offers a substantially similar charter experience to that originally booked. The provision of a substitute vessel in accordance with this clause shall not constitute a breach of contract and shall not, of itself, entitle the customer to a refund, price reduction, compensation or damages.
Should a customer decide that the substitute vessel is not acceptable, they must notify Sail Malta Charters before boarding and before the charter commences. If the customer chooses to board the substitute vessel and the charter commences, the customer shall be deemed to have accepted the substitute vessel and the charter service provided.
Customers are required to raise any concerns regarding the vessel, equipment, facilities or services as soon as reasonably practicable during the charter, so that Sail Malta Charters has a fair opportunity to investigate and, where possible, rectify the issue. Complaints raised only after the charter has concluded, where no opportunity to remedy the matter was provided, may affect the customer's entitlement to any refund, compensation or other remedy.
Sail Malta Charters is committed to providing a high standard of service and takes all customer complaints seriously. Every complaint is subject to a thorough internal review to establish the facts before any decision is made. While genuine concerns will always be considered fairly, dissatisfaction based solely on subjective expectations, where the contracted service has otherwise been delivered, shall not in itself constitute grounds for a refund or compensation.
Acceptance of the charter, boarding the vessel and continued participation in the charter shall constitute confirmation that the customer accepts the vessel, its condition and the services provided as suitable for the purpose of the booking, subject only to any concerns raised promptly during the charter in accordance with these Terms and Conditions. Failure to notify Sail Malta Charters of any such concerns during the charter shall be deemed acceptance of the services provided.
The skipper has full authority at all times to ensure the safety of:
· Guests
· Vessel
· Crew
Guests must follow all instructions given by the skipper or crew.
Guests agree to:
· Act responsibly and respectfully on board
· Follow safety briefings and rules
· Avoid reckless behaviour
We reserve the right to terminate the charter without refund if guest behaviour endangers safety or the vessel.
· Alcohol consumption is permitted in moderation.
· Excessive intoxication, illegal substances, or unsafe behaviour are strictly prohibited.
Guests are responsible for any damage caused to the vessel, equipment, or fittings due to negligence or misuse. Repair or replacement costs may be charged to the client.
Guests bring personal items on board at their own risk. Sail Malta Charters is not responsible for loss or damage to personal belongings.
If the charter exceeds the agreed time due to guest-related delays, additional charges may apply.
Any issues should be raised during the charter to allow us to address them in a timely manner.
Guests confirm they are medically fit to participate in a boat charter. Any relevant medical conditions must be disclosed prior to departure.
Unless otherwise requested, Sail Malta Charters may take photos or videos during the charter for marketing purposes. Clients may opt out by informing us in advance.
We are not liable for cancellations or delays caused by events beyond our control, including but not limited to severe weather, mechanical failure, port authority restrictions, or acts of God.
These Terms and Conditions are governed by the laws of Malta. Any disputes shall be subject to Maltese jurisdiction.
